Terms of service

Jeon Sports e.U. for the online shop “GrindTime Mouthguards”

Version: 2026

1. Scope of Application

1.1 These General Terms and Conditions apply to all orders placed by consumers and businesses through the online shop of Jeon Sports e.U. at www.grindtimemouthguards.com.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 A business is any natural or legal person or partnership with legal capacity that, when entering into the contract, acts in the exercise of its trade, business or profession.

1.4 The customer's deviating, conflicting or supplementary terms and conditions shall only become part of the contract if Jeon Sports e.U. has expressly agreed to their application in writing or in text form.

2. Contractual Partner

The contract is concluded with:

Jeon Sports e.U.
Owner: Johannes Patterer
Mozartstraße 55/16
9020 Klagenfurt am Wörthersee
Austria

Company Register Number: FN 678185g

3. Products and Intended Use

3.1 Jeon Sports e.U. offers, in particular, sports mouthguards, storage cases and related accessories through its online shop.

3.2 The essential characteristics of the products are set out in the respective product description, product images, instructions for use and other information provided in the online shop.

3.3 Mouthguard products are intended exclusively for the sporting use described in the product description and instructions for use. They may only be used in accordance with the applicable fitting, usage, cleaning, storage and safety instructions.

3.4 A sports mouthguard may reduce the risk of certain dental, oral and jaw injuries; however, it cannot completely prevent injuries. The product does not replace medical, dental or orthodontic advice.

3.5 In the case of braces, dental prostheses, loose teeth, jaw problems, injuries to the oral area or other dental conditions, a dentist, orthodontist or other suitably qualified professional must be consulted before use.

3.6 Children and adolescents may only use the product under the supervision and responsibility of an adult. The selection of the appropriate size, fitting and regular checking of the fit are the responsibility of the supervising person.

3.7 Minor variations in colour, shape, size, packaging or appearance may occur due to production, materials, screen display or batch differences, provided that these do not impair the intended contractual use, safety or essential product characteristics.

4. Orders and Conclusion of Contract

4.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

4.2 The customer may select products, add them to the shopping cart and review, amend or cancel the order at any time before submitting it.

4.3 By clicking the button “Order with obligation to pay”, “Pay now”, “Buy” or another comparable order button that clearly indicates an obligation to pay, the customer submits a binding offer to conclude a purchase contract.

4.4 Jeon Sports e.U. may accept this offer by sending an order confirmation by email, dispatching the goods or issuing another express declaration of acceptance. The relevant time is whichever of these events occurs first.

4.5 An automatically sent acknowledgement of receipt of the order merely confirms that the order has been received and does not constitute acceptance of the offer unless acceptance is expressly declared therein.

4.6 The contract text is stored by Jeon Sports e.U. The customer receives the order details, these General Terms and Conditions and the relevant consumer information by email or may view them in their customer account, provided that a customer account has been created.

4.7 Orders may only be placed by persons with full legal capacity. Minors may only place orders with the consent of their legal representatives.

5. Prices, Value Added Tax and Shipping Costs

5.1 The prices displayed in the online shop at the time the order is placed shall apply.

5.2 All prices are final prices, plus the shipping costs displayed at checkout.

5.3 Jeon Sports e.U. applies the small business scheme pursuant to Section 6(1)(27) of the Austrian Value Added Tax Act (UStG). Accordingly, no value added tax is shown.

5.4 Shipping costs, delivery options and any additional costs are clearly displayed to the customer before the order is placed.

5.5 Obvious pricing, spelling or input errors are reserved. In such cases, the customer will be informed without undue delay. In such circumstances, no contract shall be concluded, or the contract may be contested in accordance with the statutory provisions.

6. Payment

6.1 The customer may choose from the payment methods offered at checkout.

6.2 Unless expressly agreed otherwise, payment is due immediately upon completion of the order.

6.3 When using external payment service providers, such as credit card providers, PayPal, Klarna, Shopify Payments or comparable providers, the respective terms and conditions of the payment service provider shall also apply.

6.4 Jeon Sports e.U. reserves the right not to offer certain payment methods in individual cases or to offer additional payment methods.

6.5 As a general rule, the goods will only be dispatched after full payment has been received, unless another payment method or payment period has been expressly agreed.

7. Delivery and Shipping

7.1 Delivery shall be made to the delivery address specified by the customer.

7.2 Delivery is available exclusively to countries that can be selected as delivery destinations at checkout.

7.3 The estimated delivery times are stated in the online shop, on the product page, at checkout or in the order confirmation. Where advance payment has been agreed, delivery periods begin upon receipt of payment.

7.4 The customer is obliged to provide complete and correct delivery details. If additional costs arise as a result of incorrect, incomplete or subsequently amended delivery details, Jeon Sports e.U. may charge these costs to the customer, provided that the customer is responsible for the incorrect information.

7.5 If delivery fails for reasons attributable to the customer, the customer shall bear the reasonable additional costs incurred as a result. This does not apply if the customer validly withdraws from the contract or exercises the right of withdrawal.

7.6 If an ordered product is temporarily or permanently unavailable, Jeon Sports e.U. will inform the customer without undue delay. Any payments already made will be refunded without undue delay in such cases, unless a replacement product or later delivery has been agreed.

7.7 In the case of consumers, the risk of loss of or damage to the goods shall pass to the customer only when the goods are handed over to the customer or to a person designated by the customer who is authorised to receive them. If the customer has independently commissioned a carrier that was not offered as a shipping option by Jeon Sports e.U., the risk shall pass upon handover of the goods to that carrier.

8. Retention of Title

The goods shall remain the property of Jeon Sports e.U. until payment has been made in full.

9. Right of Withdrawal for Consumers

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an unequivocal statement sent by email or post.

Address:

Jeon Sports e.U.
Mozartstraße 55/16
9020 Klagenfurt am Wörthersee
Austria

Email: grindtime.mouthguards@gmail.com

You may use the attached model withdrawal form for this purpose, but this is not mandatory. If you use this option, we will promptly send you confirmation of receipt of such a withdrawal, for example by email.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

10. Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to products that have already been used or are no longer in a hygienically sound condition. For hygiene reasons, only unused products in their original condition may be returned.

11. Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract (see the information under “Returning Products”). The deadline is met if you dispatch the goods before the fourteen-day period has expired. You shall bear the direct costs of returning the goods. You shall only be liable for any diminished value of the goods if that loss in value results from handling the goods in a way that was not necessary to establish their nature, characteristics and functioning.

12. Returning Products

12.1 Returns must be sent to the following address:

Jeon Sports e.U.
Mozartstraße 55/16
9020 Klagenfurt am Wörthersee
Austria

12.2 Where possible, the customer is asked to include the order number or a copy of the order confirmation with the return so that it can be identified more quickly. This is not a prerequisite for exercising statutory rights.

12.3 The customer is asked to package the goods in such a way as to minimise the risk of transport damage.

12.4 Returns sent with postage unpaid may be refused where legally permissible. The customer's statutory rights remain unaffected.

13. Model Withdrawal Form

If you wish to withdraw from the contract, you may complete this form and return it to us. Use of this form is not mandatory.

14. Voluntary Returns and Exchanges

14.1 Any voluntary exchange or voluntary return outside statutory claims shall only take place following an express agreement with Jeon Sports e.U.

15.2 In the event of defective goods, consumers have the statutory rights, in particular the right to repair, replacement, price reduction or rescission of the contract, in accordance with the applicable statutory provisions.

15.3 There is no defect where an impairment or damage is attributable to improper fitting, improper use, normal wear and tear, lack of care, improper cleaning, incorrect storage, failure to follow the instructions for use or subsequent alteration of the product by the customer.

15.4 The customer is asked to report obvious transport damage to the delivery service as soon as possible and to inform Jeon Sports e.U. This does not restrict the customer's statutory rights.

15.5 Guarantees shall only apply if they are expressly designated as such and declared in writing. A mere product description does not constitute a guarantee.

16. Liability

16.1 Jeon Sports e.U. shall be liable in accordance with the statutory provisions.

16.2 Liability for damage resulting from injury to life, body or health, for damage caused intentionally or by gross negligence, and under mandatory product liability provisions shall remain unlimited.

16.3 There shall be no liability for damage arising from use of the product contrary to the instructions for use or safety instructions, improper use, use for an unintended purpose or unauthorised modifications, provided that the damage is attributable to these circumstances and no mandatory statutory liability applies.

16.4 Jeon Sports e.U. shall not be liable for ensuring that a mouthguard prevents every injury. Sport, particularly contact and team sports, involves a risk of injury that can be reduced by protective equipment but cannot be completely eliminated.

17. Discount Codes, Vouchers and Promotions

17.1 Discount codes, vouchers and promotions are valid only subject to the conditions specified for each.

17.2 Unless otherwise stated, only one discount code may be redeemed per order.

17.3 Discount codes and vouchers cannot be exchanged for cash, cannot be applied retrospectively and are non-transferable, unless expressly stated otherwise.

17.4 Jeon Sports e.U. may limit promotions by time, quantity or to specific products.

17.5 In the event of misuse, manipulation, multiple use contrary to the promotion terms or technical errors, Jeon Sports e.U. reserves the right to reject discount codes or promotions or cancel affected orders, insofar as legally permissible.

18. Customer Account

18.1 If the online shop allows the creation of a customer account, the customer is obliged to provide truthful and complete information.

18.2 The customer is obliged to keep login credentials confidential and protect them against unauthorised access.

18.3 Jeon Sports e.U. is entitled to suspend or delete customer accounts if there are reasonable grounds to suspect misuse, unlawful use or a breach of these General Terms and Conditions.

19. Intellectual Property

19.1 All content in the online shop, in particular texts, images, videos, product designs, logos, trademarks, graphics and other content, is protected by copyright, trademark law or other applicable legal provisions.

19.2 The use, reproduction, modification, distribution or other exploitation of this content is not permitted without the prior express consent of Jeon Sports e.U.

21.2 The customer is obliged to provide a correct and accessible email address and to ensure that emails from Jeon Sports e.U. can be received.

22. Force Majeure

22.1 Events beyond the control of Jeon Sports e.U., in particular natural events, official measures, strikes, transport disruptions, supply chain disruptions, power outages, pandemics, war, civil unrest or technical failures, may reasonably extend delivery times.

22.2 The customer's statutory rights, in particular rights in the event of delayed delivery, remain unaffected.

23. Alternative Dispute Resolution

23.1 Jeon Sports e.U. endeavours to resolve disputes with customers directly and amicably.

23.2 Jeon Sports e.U. is neither obliged nor currently willing to participate in dispute resolution proceedings before a consumer arbitration body, unless required by law.

23.3 Statutory information obligations arising after a specific dispute has occurred remain unaffected.

24. Contract Language

The contract language is German. If the online shop or individual content is translated into other languages, the German version shall prevail in cases of doubt.

25. Applicable Law and Place of Jurisdiction

25.1 Austrian law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

25.2 In relation to consumers, this choice of law shall apply only to the extent that it does not restrict any mandatory consumer protection provisions of the country in which the consumer has their habitual residence.

25.3 The statutory places of jurisdiction shall apply to actions brought against consumers.

25.4 For contracts with businesses, the court with subject-matter jurisdiction at the registered office of Jeon Sports e.U. in Klagenfurt am Wörthersee shall have exclusive jurisdiction, insofar as legally permissible.
